TERMS & CONDITIONS
PRICING
All published prices are in US dollars and are subject to change without notice. Pricing does not include taxes, crating, shipping, insurance or installation and is valid for thirty days from date of formal quote or invoice.
SALES
All orders are initiated by a 50% non-refundable deposit. The balance plus shipping costs and any applicable taxes is due when the order is complete. Shipping arrangements are made when the balance due is paid in full. We accept payment by check, wire transfer or credit card.
LEAD TIME
Lead times begin with receipt of deposit and confirmation of all order details. Lead times are exclusive of shipping and vary depending on product line. Most collections require 10 -12 weeks to fabricate. In-stock purchases ship within 1-2 weeks unless otherwise noted. Quoted lead times are estimates only and not guaranteed.
RUSH ORDERS
When available, expedited lead times are subject to an upcharge. Please contact the studio to discuss your project requirements.
VARIATION
Our products have been carefully photographed to show colors and finishes as accurately as possible. Variation between product images and the actual product can occur. Natural materials such as stone and wood have inherent variation in color and veining. Hand blown glass colors contain a range of tones and are intentionally used with variability in mind.
SHIPPING
We offer local delivery and domestic or international shipping. Smaller items ship via FedEX Ground, while larger items are crated and dispatched by our local shipper. Delivery options include commercial warehouse delivery, residential curb side delivery and white glove delivery. Not all delivery types are available in all locations, please contact the studio for more information. For international shipments, all taxes and duties will be billed to the consignee by customs at import.
DAMAGE
Damage claims must be made in writing and reported within 48 hours of receipt of goods. Claims must include photographs the goods and the packaging as well as a written description. If damage has occurred in shipping, all packaging must be retained by the receiver. Failure to do so may invalidate any claim.
STORAGE
Finished merchandise can be stored for up to 14 days after its completion, a storage fee of $100 per week will apply thereafter. If shipment is not made within 120 days, Avram Rusu Studio reserves the right to reallocate the product and cancel the order.
RETURNS
As all pieces are hand made to order, we do not offer cancellation, exchanges or returns.
WARRANTY
We warrant our products to be free of defects in material or workmanship under normal use and service for a period of one year from date of purchase. We reserve the right to inspect the damaged product before having any obligation under this limited warranty. All arrangements and costs of shipping for inspection are the sole responsibility of the purchaser. We shall repair or replace the defective unit covered by this warranty at our sole discretion. We are not responsible for damage caused by improper assembly, installation, maintenance, misuse, cleaning, shipping or normal wear and tear. This warranty applies to the original Buyer only and is not transferrable. All other warranties express or implied are excluded. Seller reserves the right to modify its limited warranty at any time in its sole discretion.
LIMITATION OF LIABILITY
We will not be liable for any loss of income, loss of profits, loss of markets, loss of reputation, loss of customers, loss of use, loss of an opportunity even if we had knowledge that such damages or loss might arise or for any indirect, incidental, special or consequential damages or loss howsoever arising including without limitation breach of contract, negligence, willful act or default, latent defects or inherent vice in the contents of the shipment; criminal acts of third parties such as theft and arson. In no event shall the seller’s total liability in respect of any and all claims of any kind whether in contract, warranty, tort (including negligence), strict liability or otherwise arising out of or in connection with, or resulting from our sale, delivery, resale, repair, replacement or furnishing of any products, including performance or breach of the warranty set forth in these terms and conditions, exceed the purchase price of the good(s) that give rise to the claim, and any and all such liability shall terminate upon the expiration of the applicable warranty period for such goods.
FORCE MAJEURE
We shall not be liable to the buyer or deemed to be in default for any delay or failure in performance resulting directly or indirectly from and including without limitation, acts of God, civil or military authority, acts of the public enemy, terrorism, war, riots, civil disturbances, insurrections, accidents, fire, explosions, earthquakes, floods, these elements or any other cause beyond our reasonable control.
LAW AND JURISDICTION
Any disputes arising from or related to this contract shall be subject solely to the laws and the courts of Kings County, New York.
AMMENDMENT
These terms and conditions may not be amended or modified in any way except in written instrument duly executed by both parties. These terms supersede all other written or oral agreements between the buyer and Avram Rusu Studio.
